We understand that business circumstances can change and that it may sometimes be necessary to cancel or pause a project. This Cancellation Policy sets out the process and financial implications of cancelling an engagement with S.S Building App Private Limited. We encourage all clients to discuss any concerns with us before initiating a formal cancellation, as we are often able to find solutions that work for both parties.
You may cancel a project at any time by providing written notice to us at support@ssbuildapp.site. The effective date of cancellation is the date on which we receive your written notice. Upon cancellation, you are obligated to pay for all work completed up to the effective date of cancellation, calculated on a time-and-materials basis at our standard rates, subject to a minimum payment equal to the deposit amount.
While no minimum notice period is required for cancellation, we request at least 14 days' notice where possible. This allows us to wind down the project in an orderly manner, prepare handover documentation, and reallocate our team's time. Projects cancelled with less than 7 days' notice may incur an additional administrative fee of up to 5% of the total project value to cover the cost of the abrupt transition.
We reserve the right to cancel a project in the following circumstances: non-payment of invoices within 30 days of the due date; material breach of the Project Agreement by the client that is not remedied within 14 days of written notice; conduct by the client that makes continuation of the project impractical or harmful to our team; or circumstances beyond our reasonable control (force majeure) that prevent us from continuing the project. In the event of company-initiated cancellation due to our own inability to continue, we will refund any payments received for work not yet completed.
Upon cancellation, we will provide you with all completed work product, including source code, design files, documentation, and any other deliverables produced up to the cancellation date, subject to receipt of all outstanding payments. Handover materials will be delivered within 10 business days of the cancellation date and receipt of final payment.
Monthly maintenance retainer contracts may be cancelled with 30 days' written notice. The final month's retainer fee is payable in full regardless of the cancellation date within that month. We will provide a final handover report and any outstanding deliverables within 10 business days of the end of the notice period.
Upon cancellation and settlement of all outstanding payments: all intellectual property rights in completed deliverables transfer to you as described in our Terms of Service; both parties are released from their obligations under the Project Agreement, except for obligations that survive termination (including confidentiality, payment of outstanding amounts, and intellectual property provisions); and we will delete any confidential client data from our systems within 30 days of cancellation, unless we are required to retain it by law.
If you need to pause rather than cancel a project, please contact us as early as possible. We can accommodate project pauses of up to 8 weeks without additional cost, subject to team availability. Pauses longer than 8 weeks may require a re-scoping of the project and a revised timeline and cost estimate, as our team's availability and the technology landscape may have changed.
